Folio terms
The terms on which a school subscribes to PaperTrail Folio, and the rules for everyone who uses it.
1. The agreement
These terms apply between PaperTrail Academic (“we”, “us”) and a school that subscribes to PaperTrail Folio (“the school”). Together with the school’s order or invoice and the data processing agreement, they make up the agreement. If the order or the data processing agreement says something different, the order wins on its own subject (such as price and term) and the data processing agreement wins on personal data.
Teachers, students and others use Folio under their school’s subscription. Section 5 applies to everyone who uses Folio.
2. The service
Folio is a web application for recording and organising IB Diploma Programme work (CAS, the Extended Essay, TOK, internal assessments and predicted grades) and preparing it for the IB. We keep improving it, and may change how it works, but we will not remove a main part of it during a school’s paid term without agreeing that with the school. Optional add-ons, such as the weekly Drive copy and Ask Folio, are provided only if the order includes them.
3. Accounts
- We set up the school and its first administrators. From then on, the school adds and removes its own people.
- People sign in with the account their school gives them. Each person is responsible for keeping their account secure and for what is done with it.
- The school keeps its list of people up to date, including removing access for people who leave.
4. The school’s part
- The school decides what is recorded in Folio and has the right to put it there, including the notices and consents its laws require for students and staff.
- The school is responsible for how its staff and students use Folio.
- The school tells us promptly if it believes an account has been misused.
5. Acceptable use (everyone)
Do not use Folio to:
- break the law, or upload anything you do not have the right to upload;
- try to see records you have not been given access to, or another school’s records;
- test, probe or get around Folio’s security without our written permission;
- upload malicious software, or put an unreasonable load on the service;
- copy, resell or rebuild Folio, or give access to people outside the school;
- harass anyone, or post content that is abusive or inappropriate for a school.
We may suspend an account that breaks these rules, and we will tell the school.
6. The school’s data
- The school owns everything it and its people put into Folio. We claim no rights in it beyond what we need to run Folio for the school.
- We handle personal data only as the data processing agreement and the Folio privacy policy describe.
- The school can export its records and files at any time.
7. Ask Folio
Ask Folio is an optional AI assistant that explains how to use Folio. Its answers can be wrong, so check anything that matters against Folio itself. It does not help with students’ assessed work. The school decides whether it is switched on, separately for staff and students.
8. Folio and the IB
- This product has been developed independently from and is not endorsed by the International Baccalaureate Organization.
- Folio prepares files, forms and marks for the IB, but the school checks them and submits them. The school remains responsible for its submissions to the IB and for meeting the IB’s requirements and deadlines.
- The IB changes its requirements from time to time. We work to keep Folio up to date, but the IB’s own published documents always take precedence.
- Folio does not detect AI-written or plagiarised work. Any judgement about a student’s work is the teacher’s.
9. Fees
The fees, the subscription term and the payment terms are set out in the school’s order or invoice. Unless the order says otherwise, subscriptions run for a school year and are paid in advance. Fees do not include taxes, which are added where they apply.
10. Availability and support
We work to keep Folio available and to fix problems quickly, but we do not promise it will never be interrupted, for example during maintenance or an outage at one of our providers. Support is by email and through “Report a problem” in Folio.
11. Term and ending
- The subscription runs for the term in the order and renews only if the school and we agree.
- Either side may end the agreement if the other seriously breaks it and does not put it right within 30 days of being told.
- When the agreement ends, the school has 60 days to export its records and files. We then delete them within 90 days of the end, as the privacy policy and the data processing agreement describe.
12. Ownership
We own Folio, its software and its design. The school gets the right to use Folio during its subscription, as these terms set out. If the school sends us suggestions, we may use them to improve Folio without owing anything for them.
13. Warranties
We provide Folio with reasonable care and skill. Apart from that and what these terms say, Folio is provided “as is”, and we give no other promises, to the extent the law allows.
14. Liability
Neither side is liable to the other for indirect or consequential loss, or for loss of profit. Our total liability under the agreement is limited to the fees the school paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited.
15. Changes to these terms
We may update these terms. We will tell schools about a change that matters at least 30 days before it takes effect. A change does not affect a school’s current paid term unless the school agrees.
16. Law and contact
These terms are governed by the laws of the State of Delaware, USA, unless the school’s order names another law.
